Terms of Service

Last updated: October 27, 2026

These Terms of Service ("Terms") govern your use of the Separate Ways app and website (together, the "Service"), operated by Separate Ways ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

What Separate Ways is

Separate Ways is a free app and divorce concierge support service that helps people organize and navigate a divorce: tracking their situation, documents, property, finances and children's needs, and, when they choose, connecting with attorneys, family and child counselors, real estate agents and other professionals in our Trusted Network.

Separate Ways is not a law firm, does not provide legal advice, and does not represent you in any legal matter. Nothing in the Service creates an attorney-client relationship between you and Separate Ways. If you connect with an attorney or other professional through the Service, your relationship with that professional — including any attorney-client relationship, fees, and professional obligations — is between you and that professional, governed by their own engagement terms, not by Separate Ways.

Core use of the app and your divorce concierge is free. You only pay a professional directly if and when you choose to hire them, or if you choose an optional Separate Ways premium service, which will be clearly priced before you pay.

Your account

  • You must provide accurate information when creating your account and keep it up to date.
  • You are responsible for safeguarding your account credentials and for activity that occurs under your account.
  • You must be at least 18 years old to create an account.
  • Separate Ways may suspend or deactivate an account that violates these Terms, is used fraudulently, or poses a safety risk to others.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose, or to harass, threaten or harm another person.
  • Impersonate another person or misrepresent your affiliation with any person or entity.
  • Upload content that infringes someone else's rights, or that you do not have the right to share.
  • Attempt to access another user's account or data, or probe, scan or test the Service's security.
  • Use automated means to access or scrape the Service without our written permission.

Professionals in the Trusted Network

Attorneys, family and child counselors, real estate agents and other professionals who join our Trusted Network are independent professionals or firms, not Separate Ways employees or agents. Separate Ways facilitates the connection and, where applicable, charges network professionals for participation and client connections — that cost is never passed on to you for using the app or your concierge. Separate Ways does not guarantee the outcome of any professional engagement and is not a party to the agreement between you and any professional you choose to work with.

Payments

If you or a professional pays for a service through the Service, payments are processed by Stripe, our third-party payment processor, subject to Stripe's own terms. Fees for optional premium services, or for a professional's services, will be disclosed before you are charged.

Your content

You retain ownership of the information, documents and content you provide through the Service ("your content"). You grant Separate Ways a limited license to host, store, process and display your content solely to provide the Service to you and to anyone you choose to share it with (such as a connected attorney or counselor). We do not use your content to train external, non-Separate-Ways products, and we do not sell your content.

Account deletion

You may delete your own account at any time from Settings in the app. Requesting deletion deactivates your account immediately, and your personal case content is permanently deleted after a 14-day grace period, during which you may cancel the request. Billing records we are required to retain for legal or tax reasons are not affected by account deletion. Full details are in our Privacy Policy.

Separate Ways may also suspend, deactivate or terminate your access to the Service if you violate these Terms, and will provide notice where reasonably possible.

Disclaimers

The Service is provided "as is" and "as available." Separate Ways provides general educational information and organizational tools; it does not provide legal, financial, tax or medical advice, and your use of the Service does not substitute for advice from a licensed professional. To the fullest extent permitted by law, Separate Ways disclaims all warranties, express or implied, regarding the Service.

Limitation of liability

To the fullest extent permitted by law, Separate Ways will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising from your use of the Service or your relationship with any professional you connect with through it. Separate Ways' total liability for any claim arising from the Service is limited to the amount you paid Separate Ways, if any, in the twelve months before the claim arose.

Changes to these Terms

We may update these Terms as the Service changes. We will update the "Last updated" date above, and for material changes we will provide additional notice, such as an in-app or email notification. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
